Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
(the “Waiver and Release”)
I, the undersigned volunteer (the “Volunteer”), on behalf of myself and my heirs, next of kin, executors, administrators, representatives and assigns, hereby forever waive, release, discharge and hold harmless the Alberta Cancer Foundation and Alberta Health Services (the “Organizers”), and their respective directors, officers, employees, volunteers, agents and representatives, including without limitation Event sponsors, Event contractors, Event producers, municipal, provincial and federal governing authorities, park governing agencies, third-party vendors, venue owners and operators, and all other entities or individuals involved in the organization, operation or staging of the Event (collectively, the “Releasees”), from any and all losses, liabilities, damages, costs, claims or causes of action of any kind, including for personal injury, death or property damage, arising out of or in connection with my participation as a volunteer in the Event, notwithstanding that such loss, injury or damage may have been caused or contributed to by the negligence, breach of contract, breach of statutory duty, or errors in judgment of any of the Releasees.
The 2026 Enbridge Tour Alberta for Cancer (the “Event”)
The Event is a charitable cycling event taking place in the Province of Alberta from July 18–19, 2026, in support of cancer research and patient care. Volunteer activities may include, but are not limited to, registration support, route marshaling, traffic control assistance, rest stop support, food and beverage handling, equipment handling, participant support, set-up and tear-down, and other duties as assigned. For greater certainty, the Event includes all activities related to the Event occurring before, during and after the cycling portions, including volunteer orientation, training, and post-Event activities.
(the “Organizers”) The Organizers are M1 Sports Management Inc. and the Alberta Cancer Foundation staff, involved in the planning, administration, coordination, delivery, and oversight of the Event, including without limitation event managers, directors, officers, employees, contractors, and representatives. For greater certainty, the Organizers include any other individuals or entities engaged by or acting on behalf of the foregoing in connection with the organization, operation, safety, or delivery of the Event.
Assumption of Risk
I acknowledge that volunteering at the Event involves inherent risks, dangers and hazards. I freely and voluntarily assume all risks associated with my participation as a volunteer, including but not limited to: physical exertion; traffic hazards; motor vehicles; cyclists; uneven terrain; weather conditions; equipment handling; lifting and carrying; slips, trips and falls; exposure to illness or infectious disease; and the risk of serious injury, permanent disability or death. I confirm that I am physically and mentally capable of performing the volunteer duties assigned to me and that I will remove myself from any activity I believe to be unsafe. I acknowledge that the Organizers are relying on these representations in permitting me to volunteer.
Orientation, Screening and Training
I acknowledge that volunteer participation may require screening, orientation and/or training, and I agree to comply with all instructions, policies, procedures and safety requirements communicated by the Organizers at all times.
Volunteer Conduct and Safety
I agree to: Follow all safety instructions provided by the Organizers; Only perform duties assigned or approved by the Organizers and not act outside the scope of my volunteer role; Act responsibly and within the limits of my training and assigned responsibilities; Not consume alcohol, cannabis or illegal substances while volunteering; Use any equipment provided in a safe and responsible manner I acknowledge that I am responsible for the correct operation of any equipment/property used during the event. I acknowledge that if I choose to not operate this equipment/property in a safe manner, I am at a much greater risk of injury.; and Promptly report any injury, hazard, incident or near-miss to the Organizers. I understand that failure to follow instructions or act safely may result in my immediate removal from volunteer duties.
No Compensation / No Employment Relationship
I acknowledge that I am volunteering for my services freely and without expectation of compensation. I understand that I am not an employee, contractor or agent of the Organizers and that no employment or agency relationship is created by my participation as a volunteer.
Media Release
I grant the Organizers full and unrestricted permission to use my name, likeness, image, voice or appearance captured in photographs, video, audio recordings or other media created in connection with the Event, for any purpose including promotional, marketing and commercial use, without compensation and without further consent, unless otherwise required by law.
Personal Information (PIPA)
I consent to the collection, use and disclosure of my personal information by the Organizers for purposes related to volunteer coordination, safety, logistics and communication. Personal information may be disclosed to government authorities as required by law and is protected under Alberta’s Personal Information Protection Act (PIPA).
I consent to receiving communications from the Alberta Cancer Foundation and understand that I may withdraw my consent at any time.
Age Confirmation
I confirm that I am 14 years of age or older. If I am under 18 years of age, I acknowledge that parental or legal guardian consent is required and must be provided through the Minor Volunteer Addendum.
Acknowledgement and Governing Law
IN SIGNING THIS WAIVER AND RELEASE, I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND THAT I AM NOT RELYING ON ANY ORAL, WRITTEN OR VISUAL STATEMENTS, INCLUDING PROMOTIONAL MATERIALS, MADE BY ANY OF THE RELEASEES. I UNDERSTAND THAT BY SIGNING THIS WAIVER OR BY REGISTERING TO VOLUNTEER ONLINE, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
This Waiver and Release shall be governed exclusively by and interpreted in accordance with the laws of the Province of Alberta. I irrevocably submit to the exclusive jurisdiction of the courts of Alberta, and any legal proceedings relating to this Waiver and Release shall be commenced in Alberta only.
PARENTAL CONSENT FOR MINOR PARTICIPANT AND INDEMNITY AGREEMENT
I have read and understood the above waiver, release and indemnity and have discussed the same with the minor person identified and/or signing above. I am satisfied the said minor understands the waiver and release and his/her obligations as set out therein. In consideration of the participation of my minor child/ward I too agree to waive, release and indemnify the Organizers and Releasees in the terms set out above. I am aware that by signing this Agreement I am waiving substantial legal rights, which my minor child/ward and I, our respective heirs, executors, administrators and next of kin may have against the Organizers and Releases.
